Sponsorship Terms & Conditions
Please read this agreement carefully before purchasing a sponsorship package. By completing your purchase, you agree to be bound by these terms.
This Podcast Sponsorship Agreement ("Agreement") is entered into between FMG Leading, LLC, d/b/a Step Wise Podcast ("Host"), operated by Dr. Foster W. Mobley, and the individual or organization completing a sponsorship purchase ("Sponsor").
By completing a purchase on this page, Sponsor represents that they have the authority to enter into this Agreement on behalf of themselves or their organization.
The following packages are available for purchase. Sponsor's selection at checkout constitutes acceptance of the corresponding deliverables and terms outlined below.
Sponsor agrees to deliver the following no later than 10 business days prior to the scheduled episode recording date:
- For Sponsor-Provided Content: a written ad read script of 60 seconds or fewer, plus brand assets (logos, URLs, promo codes)
- For Foster-Delivered Content: a brand brief of no more than two pages describing the product or service, key messaging, and any required claims or disclosures, plus brand assets
- Single Episode packages: One ad read placement (pre-roll or mid-roll at Host's discretion), Sponsor link in episode show notes, one social media mention
- Full Season packages: One ad read per episode across all Season 3 episodes, Sponsor link in every episode's show notes, minimum three social mentions across the season, Sponsor recognition on the Step Wise podcast page for the duration of Season 3
Foster-Delivered Content: FMG Leading reserves the right to write, edit, and deliver ad reads in Foster Mobley's natural voice and style. Sponsor may request one round of revisions. FMG Leading retains final editorial discretion over all delivered content.
Full payment is due at time of purchase, before production of sponsored content begins. Payment is processed securely through Squarespace Payments.
All fees are non-refundable once production of the sponsored episode has commenced, except as outlined in Section 7 (Cancellation Policy).
FMG Leading reserves the right to reject or request modification of any Sponsor-provided content that, in FMG Leading's sole judgment:
- Contains false, misleading, or unsubstantiated claims
- Promotes products or services that conflict with Step Wise's values or audience
- Violates applicable law or platform terms of service
Step Wise is an editorial podcast, not an advertising platform. FMG Leading's editorial content and guest selection are entirely independent of all sponsorship relationships.
Important: Foster-Delivered Content is presented as Foster Mobley's personal recommendation only where Foster has independently determined such an endorsement to be genuine. FMG Leading will include appropriate sponsored content disclosures in all episodes containing paid placements, in accordance with FTC guidelines.
Cancellation by Sponsor: If Sponsor cancels more than 15 business days prior to the scheduled recording date, Sponsor is entitled to a credit toward a future episode. No cash refunds will be issued.
Cancellation by Host: If FMG Leading cancels a scheduled episode for reasons within its control, Sponsor will be offered a comparable replacement episode or a full refund at Sponsor's election.
Force Majeure: Neither Party shall be liable for delays or failures caused by circumstances beyond their reasonable control, including illness, technical failure, or acts of nature.
Sponsor grants FMG Leading a limited, non-exclusive license to use Sponsor's name, logo, and brand assets solely for the purpose of fulfilling deliverables under this Agreement.
FMG Leading retains all rights in each podcast episode, including the ad read as recorded. Sponsor may not reproduce, rebroadcast, or distribute any episode or portion thereof without prior written consent from FMG Leading.
Sponsor may share clips of the ad read for its own promotional purposes, provided such use does not misrepresent Foster Mobley's views or endorsements beyond the scope of the recorded content.
In no event shall either Party be liable for any indirect, incidental, special, or consequential damages arising out of or related to this Agreement. FMG Leading's total liability shall not exceed the Sponsorship Fee paid by Sponsor.
Each Party represents that it has full authority to enter into this Agreement and that its performance will not violate any applicable law or third-party agreement.
This Agreement is governed by the laws of the State of Montana. Any dispute that cannot be resolved informally shall first be submitted to mediation before either Party may initiate litigation.
This Agreement constitutes the entire understanding between the Parties and supersedes all prior discussions or representations. Any modification must be in writing and agreed to by both Parties.
